Governor Schwarzenegger vetoes medical marijuana bill

Gov. Arnold Schwarzenegger has vetoed a bill sponsored by medical marijuana advocates that would have protected most employees from being fired for testing positive for pot that they used outside the workplace with their doctor's approval.

The measure, AB2279 by Assemblyman Mark Leno, D-San Francisco, would have overturned a state Supreme Court ruling in January that allowed employers to punish workers for using medical marijuana that was legalized by a state ballot measure in 1996. Under Leno's measure, the only workers who could have been fired for using medical marijuana would have been those in safety-related or law-enforcement jobs.

"The intent of 215 was to treat marijuana like other legal pharmaceutical drugs," said Dale Gieringer, a co-author of the ballot measure and California coordinator of the National Organization for the Reform of Marijuana Laws.

The court ruling upheld a Sacramento County company's firing of a computer technician who tested positive for marijuana. The employee, Gary Ross, had a doctor's note to use the drug for pain caused by back spasms. He said he had never used marijuana at work or been impaired by its effects on the job.

But the court said neither Prop. 215 nor California's disability discrimination law requires employers to allow workers to use drugs banned by federal law. Congress has classified marijuana among the most dangerous drugs and does not recognize any legitimate use.

Leno's bill passed both houses on bare-majority, party-line votes. It would have prohibited employers from firing or discriminating against employees whose marijuana use has been approved by their doctors, as long as they did not take the drug at the workplace or during work hours.

" oh so they're doctors and patients now... no legitimate use except for them they get to loot the treasury and put innocent people in jail while simultaneously stealing their property. I hope arnie gets voted out of office this Nov. They can't stop the inevitable.

    Why'd he veto that? Even though I don't think weed should be completely legalized (medical use is great), that's a totally legitimate bill that had no reason to be vetoed. That's like firing someone because they discovered legit prescription drugs in their system.

    If he approved this, then what would happen if an employee consistently was too stoned to do their job?

    Business owners would be forced to keep on employees who couldn't do their jobs.

    That would be encroaching on their freedom to run their business as they see fit.

    I don't really care one way or another if weed ever gets legalized, I don't have a problem with it one way or another however I find it amazing with all the problems our country faces people pour their heart and souls into this stupid battle for the legalization of weed.

    Come on man if smoking weed is really that important just move your butts to a country where it is legal and stop crying about it so damn much. I mean if these stoners dedicated as much time and energy into getting and education and bettering themselves as they do protesting the legalization of weed then this country would be much better off. Like I said I dont care one way or another I dont have a problem with weed or the people who smoke it I am all about freedom but give it a rest already and grow up.

Filling thier prisons with pot heads and spending billions to support them while they did nothing that harms any one. Mother nature is not a drug and is harmless and should be legalized in the entire world.

    laws against plants are unenforceable, thus a constant struggle. it's a beautiful plant and will still be flourishing long after I am gone.

    Sounds good to me. Marijuana is highly addictive, and withdrawal symptoms often include several months of intensive physiological treatment.

    Granted it works for some people... but not everyone. Perhaps those people who believe the government shouldn't be controlling what people do should become republicans.
