WASHINGTON — A federal judge on Tuesday ordered the Bush administration to immediately release 17 Chinese Muslims and allow them to stay in the United States, ruling that they are no longer considered enemy combatants.

Federal District Judge Urbina called the detention of the 17 prisoners — ethnic Uighers, a restive Muslim minority in western China — unlawful, saying the Constitution prohibits indefinite imprisonment without charges.

Efforts to find a home for the detainees has been complicated by fears in many countries of diplomatic reprisals by China. In June, federal appeals judges issued a decision that ridiculed as inadequate the Pentagon’s secret evidence for holding one Uighur, Huzaifa Parhat, a former fruit peddler who said he had gone to Afghanistan to escape China.

    I applaud the judge for recognizing that we remain a nation of laws.

    BUT, I suspect that Bush will find some way to delay, ignore or otherwise avoid the judges order. Afterall, he only has 4 months to go.

    papaya11, I totally agree! I guess I see now why so many in the White House have been fighting Habeus Corpus for detainees, it is because they would be out of here in a heartbeat. No charges- who the heck do we think we are?

    I think if we even had a clue as to what type of evidence or lack there of. A better remark could be made. But without knowing what the government knows. Who are we to say the federal judge is correct. He could be lobbying from the bench.

    Did anyone notice that John McCain said The US will never torture AGAIN. Which is funny because for the last 3 years McCain has been stating that the US has has not and does not torture. Of course this is after McCain redefined torture to an injury permanent in nature, leaving all other methods to be fair game. He is the most evil man alive. I would expect all of move-on.org to be in GITMO by the end of McCain's first year in office!

    this is still one sided. unless we know what the judge saw who are we to simply say, "it's a judge, he must be right".

    The fact that Gitmo exists makes targets of any american traveling abroad.

    Do you have any idea how angry people across the world are knowing that there is a prison that americans run where they torture people that they have kidnapped from other countries and offer no Habeas corpus?

    Seriously. You even have child prisoners there!

    You need to release them all and go through the proper legal and moral channels in dealing with people you suspect of criminal activity.

    Locking up anyone you don't like and throwing away the key is stupid, short-sighted and wrong.

    This behavior will also have horrible consequences for otherwise innocent americans down the road.

    You were once known as a noble nation that enemy combatants could surrender to and trust that they would be treated fairly.

    Now even innocent people fear being mistakenly locked away without hope.

    It has to stop.

    The Bush Administration is appealing the ruling and will ask an appellate court to put the release on hold while they proceed with the appeal.
