Law professor fires back at song-swapping lawsuits

BOSTON (AP) -- The music industry's courtroom campaign against people who share songs online is coming under counterattack.

A Harvard Law School professor has launched a constitutional assault against a federal copyright law at the heart of the industry's aggressive strategy, which has wrung payments from thousands of song-swappers since 2003.

The professor, Charles Nesson, has come to the defense of a Boston University graduate student targeted in one of the music industry's lawsuits. By taking on the case, Nesson hopes to challenge the basis for the suit, and all others like it.

Nesson argues that the Digital Theft Deterrence and Copyright Damages Improvement Act of 1999 is unconstitutional because it effectively lets a private group - the Recording Industry Association of America, or RIAA - carry out civil enforcement of a criminal law. He also says the music industry group abused the legal process by brandishing the prospects of lengthy and costly lawsuits in an effort to intimidate people into settling cases out of court.

Nesson, the founder of Harvard's Berkman Center for Internet and Society, said in an interview that his goal is to "turn the courts away from allowing themselves to be used like a low-grade collection agency."

Nesson is best known for defending the man who leaked the Pentagon Papers and for consulting on the case against chemical companies that was depicted in the film "A Civil Action." His challenge against the music labels, made in U.S. District Court in Boston, is one of the most determined attempts to derail the industry's flurry of litigation.

The initiative has generated more than 30,000 complaints against people accused of sharing songs online. Only one case has gone to trial; nearly everyone else settled out of court to avoid damages and limit the attorney fees and legal costs that escalate over time.

Nesson intervened after a federal judge in Boston asked his office to represent Joel Tenenbaum, who was among dozens of people who appeared in court in RIAA cases without legal help.

The 24-year-old Tenenbaum is a graduate student accused by the RIAA of downloading at least seven songs and making 816 music files available for distribution on the Kazaa file-sharing network in 2004. He offered to settle the case for $500, but music companies rejected that, demanding $12,000.

The Digital Theft Deterrence Act, the law at issue in the case, sets damages of $750 to $30,000 for each infringement, and as much as $150,000 for a willful violation. That means Tenenbaum could be forced to pay $1 million if it is determined that his alleged actions were willful.

The music industry group isn't conceding any ground to Nesson and Tenenbaum. The RIAA has said in court documents that its efforts to enforce the copyright law is protected under the First Amendment right to petition the courts for redress of grievances. Bicycle recyclers empower riders

[Excerpt] A year ago, Natalie Feliciano couldn’t tell the difference between a derailleur and a bottom bracket. A bike was a thing, made up of other shiny things, all of which churned together in some strange, magical concert. Sometimes she’d walk the streets of her East Village neighborhood and see rusty frames jammed into trash cans. “I’d think, you know, what a waste,” she grimaces. “All that garbage for someone else to clean up. But I never knew how much went into a bike.”

These days, her outlook is considerably more refined. On a warm fall afternoon here, standing in the cluttered back room of Recycle-a-Bicycle’s Manhattan store, Ms. Feliciano absentmindedly runs a greasy chain through her fingers and holds forth expertly on all things two-wheeled. She talks about the sudden passion in New York for fixed-gear bikes – once popular only among reckless, bombastic couriers – and her own stable of rides, which includes a bicycle she repaired on her own time. “I like knowing I can help my friends with their bikes. I like to know that I can be there,” she says. “And I like knowing how they work. How everything fits together.”

The nuts-and-bolts approach is something Recycle-a-Bicycle has always done particularly well. The organization was founded in 1999 with a straightforward mandate: Repair abused, remaindered, broken, or worn bikes and funnel them back to consumers. At the time, New Yorkers were wary, says Lisa Stein, the executive director. Used bicycles were something for the junk pile, and most experienced riders preferred the security of a brand-new aluminum frame.

But over the past decade, Recycle-a-Bike has gained an enormous amount of local ballast. A crew of employees and volunteers now runs a pair of New York stores, one here in Manhattan and the other in the DUMBO area of Brooklyn. (DUMBO means “down under the Manhattan Bridge overpass.”) The organization’s youth programs are a big draw for students like Feliciano, who enrolled last year at her public high school. She is now an expert wrench-slinger and a paid Recycle-a-Bicycle associate. Boston Cabbies Wicked Mad About Green Taxi Rule

Boston's cabbies are a crabby crew even on the best of days, but they're especially ticked off lately. The police department's hackney division, which deals with all things taxi, has decreed that all cab drivers and operators must convert their fleets to hybrids by 2015. This has, according to the Boston Metro, caused a "measure of frustration and anger among city cabbies."

Taxi drivers are hacked about the financial ramifications of the rule. Most drive Crown Vics that can be had used for $6,000 to $7,500, while a new Prius from Boston auto dealer giant Herb Chambers goes for $24,585. That's a lot of scratch for a cab driver who, thanks to out-of-control gas prices, is already having trouble making ends meet. It doesn't help that the eco-friendlier cars cost more to insure, have tiny trunks and, in the cabbies' opinions, aren't tough enough to do the job.

The city's got no sympathy for 'em.

"Requiring taxicabs to go hybrid is an essential step in not only improving air quality, but also improving the quality of our taxi fleet," said Boston Mayor Tom Menino (known locally as Mumbles Menino). "I am confident that these new regulations will greatly improve taxi service in Boston for all residents and our many guests." Because Boston cabs are required to retire after they turn 6, Menino anticipates that 50 percent of the city's cabs will be hybrid within two years.

The cabbies may not be happy, but they should keep in mind that they're not alone. In New York, home to more than 13,000 taxis, Mayor Bloomberg has decreed that every cab must be a hybrid by 2012. Taxi operators in San Francisco have three years to cut their emissions by 50 percent, and even officials in oil-drenched Dubai are testing hybrid cabs with an eye toward switching the city's entire fleet.

The Boston taxi trade also is wicked mad that that the hybrid mandate is one of several new rules being imposed by bureaucracy-loving Beantown. The city's told them to install credit card machines and wash their windows daily, barred them from wearing sweatpants and T-shirts on the job and prohibited them from yakking on the phone while carrying passengers.

Boston drivers complain they're feeling the pinch of higher fuel prices, despite a recent fare hike. "We're pleased that the drivers are going to receive a meter-rate increase, but we were looking for $3 on the mile," said union spokesperson Donna Blythe Shaw. Someone should remind Donna that Boston's cab rates are now higher than those in New York, San Francisco, Chicago or Miami.

Requiring the Boston cab fleet to go all-hybrid is a great idea, but not if it's going to financially wipe out the people who drive that fleet. Good job, Boston, but now you've got to pony up some money to help your cabbies make the transition.
